1. Acceptance of the Terms

By accessing and using the website www.seewelltech.com (hereinafter, the “Service”), operated by HERLMET CHI S.L., owner of the SEEWELL® brand (“we”, “our”), you agree to comply with and be bound by these Terms of Service. If you do not agree with any of the conditions set forth herein, please do not use the Service or make purchases through the website.

2. Description of the Service

SEEWELL® markets a motorcycle device designed to improve visibility in rainy conditions, reducing the buildup of water and fog/condensation on the helmet visor (hereinafter, the “Product”).

3. Uso del Producto

By purchasing and using the Product, the customer understands, acknowledges, and accepts the legal warnings set out in the document "Legal Warnings".

The Product is a visibility assistance device, not a substitute for prudent riding or proper helmet maintenance.
It is the user’s responsibility to install it correctly and use it in accordance with the instructions and legal warnings provided by SEEWELL®.
The Product must be used solely for its original purpose and under the specified conditions.
Failure to comply with the warnings or tampering with the device may affect its performance and void the product warranty.

4. Limitación de Responsabilidad

HERLMET CHI S.L. shall not be liable for any damage, loss, accident, or harm resulting from improper use, incorrect installation, or tampering with the Product.

The user assumes full responsibility for the use of the device and any potential effects arising from its use outside the recommended conditions.

5. Intellectual Property

All content on the website, including texts, graphics, logos, images, designs, photographs, as well as the engineering and configuration of the Product, are the exclusive property of HERLMET CHI S.L. and are protected by national and international intellectual and industrial property regulations, and are also registered with the corresponding Patent and Trademark Offices and Industrial Property registries.

Reproduction, distribution, or use of such content without prior express written authorization is prohibited.

6. Returns and Refunds

The conditions applicable to exchanges, returns, and withdrawal rights are detailed in our “Refund Policy”.

In summary:

The customer has 30 calendar days from receipt of the order to request a return.
The product must be unopened and in its original packaging.
In the event of a manufacturing defect or shipping error, SEEWELL® will cover the transport costs.
For returns due to withdrawal, the customer will bear the costs as indicated in the corresponding policy.

7. Shipping and Delivery

Shipping and delivery conditions are detailed in our “Shipping Policy”.

In general:

Order preparation and dispatch takes 24 to 48 business hours from order confirmation.
Delivery time will depend on the assigned logistics provider and will be indicated during checkout.
Standard shipping is included for orders within mainland Spain (Península Ibérica) and the Balearic Islands.
For returns due to withdrawal, transport costs will not be included.

During periods of high demand, promotional campaigns, or logistical incidents, delivery times may vary. This will be communicated during the purchase process and shall not constitute a breach or malpractice by the seller.

8. Prices and Payments

All prices shown on the website are in euros (€) and include applicable taxes. SEEWELL® reserves the right to modify prices and promotions at any time without prior notice, guaranteeing that the applicable price will always be the one shown at the time of purchase.

Payment may be made through the secure platforms enabled on the website. Financial data will never be stored by SEEWELL®, but rather processed by certified payment service providers.

9. Product Warranty Policy

SEEWELL® is manufactured using premium-quality materials and subjected to thorough controls to ensure reliability.

In accordance with current European Union legislation (Directive (EU) 2019/771 and Royal Decree-Law 7/2021), all SEEWELL® products include a legal warranty of two (2) years from the date of delivery, covering any lack of conformity or manufacturing defect existing at the time the product is delivered.

The warranty exclusively covers manufacturing or material defects and failures that prevent the device from functioning properly in accordance with its intended purpose. It does not include wear and tear from normal use, damage caused by improper use, incorrect installation, tampering, modification, improper storage including demagnetization, accidents, or damage due to external factors.

In the event of a lack of conformity, the customer is entitled to request repair or replacement of the product at no additional cost. If these options are not possible, the customer may request a price reduction or termination of the contract with the corresponding refund.

To process a warranty-covered issue, the customer must report it via the returns or warranty form available on the website, indicating the order number and a description of the defect. Once the issue is verified, SEEWELL® will provide the next steps and will cover transport costs where applicable.

Acceptance of these Terms of Service implies agreement with all the policies listed above.

11. Jurisdiction and Applicable Law

These Terms of Service are governed by Spanish law and, failing that, by applicable European Union regulations regarding e-commerce and consumer protection.

Any dispute arising from the interpretation or execution of these Terms shall be submitted to the Courts of Colmenar Viejo and the Courts of Madrid (Spain), unless mandatory legal provisions state otherwise.
